Description
Affidavit before Joseph Clay to the effect that he had been misled by the almanack into believing that the court of common pleas at Charleston, before which he had a cause depending in which Philip Hart is plaintiff, would not meet until the third Tuesday in February; that he learned from Edward Rutledge, on Jan. 3, that the court was to sit on Jan. 12; that he made all efforts to get his witnesses before the latter date, but found it impossible so to do; that he had transmitted to Charleston by Edward Penman the affidavit of Philip Minis, his principal witness, made before one of the assistant judges in Savannah; and that Philip Minis is now too ill to give his testimony viva voce.
